Our Washington State DUI Driver’s Rights Card is the size of a business card and should be kept in your wallet with your license and proof of insurance. The card is designed by Edmonds DUI attonrey Scott W. Lawrence and is intended to help you protect your most important Constitutional rights if you are ever stopped by an officer. The card is geared toward assisting you in dealing wiht an officer in a DUI traffic stop, but is applicable to any encounter with the police. Most people are nervous and intimidated when encountered by the police. On the other hand, officers have hours and hours of training in gathering evidence and getting you to incriminate yourself. An officer, unlike a judge or jury, is not required to presume that you are innocent until proven guilty. They have no obligation to tell you the truth or help you assert your rights. If you are stopped you should know that the officer is not liklely to give you the assumption of innocence (no matter how nice he is when he stops you or how innocent you might be). You will have the chance to defend yourself in a court. However, offering a solid defense is much easier to do if you don’t throw your rights away before you ever get out of your car.

To use the card effectively.  Carry your driver’s rights card in your wallet with your license and proof of insurance. Have your license, registration, proof of insurance and the driver’s rights card ready and hand them to the officer when he approaches your vehicle (always stay in the vehicle, unless ordered out by the officer). This will let the officer know, in clear language, that you do not wish to answer questions, take tests or consent to searches. Instead, the officer will know you wish to speak with an DUI or criminal defense attorney. You should always be polite to the officer.  Do not consent to any search of yourself or your vehicle, but also do not resist any attempt to arrest or search. Do not admit to speeding, drinking or anything else.   You have a constitutional right to remain silent for a reason.  Use it.

A driver’s rights card is not a magic trick that will prevent you from being arrested for DUI or other criminal offense. What it will do is help you preserve your rights so that you have a better chance of defending yourself against DUI or other criminal charges when it counts (in court).
